1. Acceptance of Terms
These Terms and Conditions (the "Agreement") form a legally binding agreement between you and Crane by The Big Bird Tech Ltd. ("Crane", "we", "us" or "our"). They apply to your use of the Crane app, website, wallet, and related services (together, the "Crane Services").
By creating a Crane account or using Crane Services, you acknowledge that you have read, understood, and accepted these Terms, as well as our Privacy Policy and AML/KYC Policy. You must also comply with all applicable laws in your jurisdiction.
If you do not agree with these Terms, you must not use the Crane Services.
We may revise these Terms from time to time. Where material changes are made, we will provide at least 14 days’ prior notice via email, in‑app notification, or website update. Continued use of Crane Services after the notice period constitutes acceptance of the revised Terms.
2. Eligibility
· You must be at least 18 years old or the legal age of majority in your jurisdiction.
· You must have the legal capacity to enter into this Agreement.
· Some Crane Services may only be available in certain countries, based on our operating licences and compliance requirements.
3. Risks
Trading or holding digital assets carries significant risk. Markets can be volatile, and the value of digital assets may rise or fall sharply. You are solely responsible for evaluating your financial situation and risk tolerance before engaging in any transaction.
Nothing on Crane constitutes financial, investment, or professional advice. You acknowledge that you are solely responsible for your decisions.
4. About Crane Services
Through the Crane App, you may:
· Convert supported digital assets directly to Crane.
· Use the Crane Wallet to store supported digital assets and Nigerian Naira.
· Withdraw fiat currency to linked bank accounts.
We may expand or restrict available services at our discretion, subject to regulatory requirements.
5. Using Crane Services
· You must open an account and complete KYC verification.
· We may request additional documents to comply with AML/CFT laws. Failure to provide accurate information may result in suspension or termination.
· Personal data will be retained for seven (7) years after account closure, as required by AML/CFT law.
· You must not use Crane for prohibited activities listed in Appendix 1.
6. Wallet Usage
· Transactions cannot be reversed once broadcast to the blockchain.
· Crane only supports specified fiat and digital assets. Unsupported assets sent to the Crane Wallet are unrecoverable.
· Fees, including network fees, will be disclosed before transaction confirmation.
· If funds are credited in error, Crane may recover them. We will notify you prior to deduction unless the funds are linked to fraud or AML/CFT obligations.
7. General Use, Prohibited Use, and Termination
You receive a limited, non‑exclusive licence to use Crane Services for lawful purposes. Any misuse, circumvention, or prohibited activity may lead to suspension or termination.
We may suspend, restrict, or close your account if:
· Required by law, subpoena, or regulator.
· We suspect illegal or high‑risk activity.
· You breach these Terms or provide false information.
Upon closure, you will have up to 5 business days to withdraw funds unless prohibited by law or regulatory order.
8. Dispute Resolution
If you have a complaint, contact support@usecrane.co. We will acknowledge complaints within 24 hours and aim to resolve them promptly.
Before resorting to litigation, you agree to attempt resolution through mediation or arbitration (Lagos Court of Arbitration). Nigerian courts shall have final jurisdiction.
9. Taxes
You are solely responsible for determining and paying applicable taxes. Crane may provide transaction records and report to the Federal Inland Revenue Service (FIRS) or other authorities if required.
10. Liability and Warranties
Crane Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access.
Crane shall not be liable for any indirect, incidental, or consequential losses. Our maximum liability will not exceed the value of the affected transaction at issue.
11. Miscellaneous
· Governing Law: Laws of the Federal Republic of Nigeria.
· Change of Control: In case of a merger or acquisition, user data may be transferred in line with our Privacy Policy.
· Severability: Invalid provisions will not affect the enforceability of the remainder.
· Survival: Terms relating to AML/KYC, liability, disputes, and compliance obligations survive termination.
